How we Collect Personal Information

As explained further below, we collect personal information that you provide to us directly (for example, when you submit information on our Site) and automatically from your device when you visit our Site.

What Personal Information We Collect and Why

·       Visit our Site: When you visit our Site, we may collect certain personal information automatically from your device. Please see the Information about Our Site section below for details on the types of personal information we collect automatically, the purposes we collect it for and the choices you have over the collection of this information.

·       Request a Consultation: You are not required to submit any personal information in order to search for a surgeon on our Site. However, if you wish to submit a surgeon consultation request through our Site, we collect your first and last name, email address, phone number. We will share this information with the surgeon that you have chosen so that they can contact you by email or phone regarding the consultation. We do not use or retain this information for any other purpose without your consent.

·       Apply for a Surgeon Profile: If you are a surgeon and you apply to create a surgeon profile on our Site, we collect and use information to confirm your identity and credentials, contact you if we require additional information and to confirm your identity and, if approved, to generate your enhanced verified profile that is published on our Site. The information we collect includes your first and last name, date of birth, email address, phone number, profile photo (optional), personal bio (optional) and additional notes or information you would like to have displayed on your profile. We also collect information about your medical practice, and medical licensing information, and job background, accomplishments, specialization(s).

·       Purchase a Subscription: If you are a surgeon and purchase a subscription service on our Site, we or our authorized payment processor will collect your payment card information (card number, CVV, expiry date) and contact information in order to process the payment. 

·       Communicate with Us: When you contact us by email or a form on our Site, we collect the information you provide in your message and your contact information (such as email address or phone number) so we can address and respond to your query. You may also be asked for information to help us confirm your identity, such as your first and last name, email address and phone number, and additional information about your query so we can get back to you with a response. We may monitor and record our phone conversations with you for documentation, training, and quality assurance purposes.

·       Sign-up for News and Updates: If you sign-up to receive Surgency news and updates, we will collect your email address so that we can provide these messages to you. You can unsubscribe at any time by clicking the “unsubscribe” link included at the bottom of each email. You can also opt out of receiving these communications by using the information in the Contact Us section below. Please note that you may continue to receive transactional or account-related communications from us.

We do not sell or share your personal information with third parties without your consent, except for the following purposes or as required or permitted by law.

·       Surgeons: When you request a referral to a surgeon, we will disclose your personal information to the surgeon you have requested in order to make the referral and enable the surgeon to contact you directly.  

·       Service Providers: Your personal information will be transferred or otherwise made available to certain third parties that provide services on our behalf. We use service providers to provide services such as IT support, sending email communications, site hosting, data storage, payment processing. We and our service providers may access, store and otherwise process personal information outside your province and outside of Canada, including in the United States.   

·       Legal and Compliance: We and our Canadian. U.S. and other foreign service providers may provide your personal information in response to a search warrant or other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise may be required or permitted by applicable Canadian, U.S. or other law or legal process, which may include lawful access by U.S. or foreign courts, law enforcement or other government authorities. Your personal information may also be disclosed where necessary for the establishment, exercise or defence of legal claims and to investigate or prevent actual or suspected loss or harm to persons or property.

·       ·       Visiting Our Site: In general, you can visit our Site without telling us who you are or submitting any personal information. However, we collect the IP addresses of all Site visitors and other related information such as page requests, browser type, operating system and average time spent on our Site. We use this information to help us understand activity on our Site and to monitor and improve our Site.

·       Cookies: Our Site use a technology called "cookies". A cookie is a tiny element of data that our Site sends to a user’s browser, which may then be stored on the user’s hard drive so that we can recognize the user’s computer or device when they return. You may adjust your cookies settings for non-essential cookies using the “Manage Cookies” link that is available in the footer of our Site. o   To successfully opt out, you must have cookies enabled in your web browser (see your browser’s instructions for information on cookies and how to enable them). Your opt-out only applies to the web browser you use so you must opt-out of each web browser on each computer you use. Once you opt out, if you delete your browser’s saved cookies, you will need to opt-out again.

·       Analytics: We may use a third-party such as Google Analytics to help us gather and analyze information about the areas visited on the Site (such as the pages most read, time spent, search terms and other engagement data) to evaluate and improve the user experience and the Site. We do not have any control over such websites and applications, and therefore we have no responsibility or liability for the manner in which the organizations that operate such websites and applications may collect, use or disclose, secure and otherwise treat personal information. We encourage you to read the privacy policy of every website you visit.

We have implemented reasonable administrative, technical and physical measures in an effort to safeguard the personal information in our custody and control against theft, loss and unauthorized access, use, modification and disclosure. We restrict access to personal information on a need-to-know basis to employees and authorized service providers who require access to fulfil their job requirements.

We have record retention processes designed to retain personal information for no longer than necessary for the purposes set out in this privacy policy or as otherwise required to meet legal or business requirements.

Subject to applicable law, you have the right to access, update, rectify and correct inaccuracies in, and withdraw consent to the processing of, your personal information in our custody or control. We may request certain personal information for the purpose of verifying your identity.
